IN NO EVENT SHALL LINTAS88'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO LINTAS88 IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED PHILIPPINE PESOS (PHP 100), WHICHEVER IS GREATER.
lintas88 reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to: violation of these Terms; fraudulent or illegal activity; failure to complete KYC verification; prolonged inactivity; or at our sole discretion. Upon termination, your right to access and use the Platform will immediately cease.
If your account is terminated for cause (i.e., due to violation of these Terms or fraudulent activity), any remaining balance in your account may be forfeited, and you will not be entitled to any refund. If your account is terminated without cause, we will return any remaining balance to you after deducting any amounts owed to lintas88.
You may close your account at any time by contacting customer support. Upon closure, you must withdraw any remaining balance in accordance with our withdrawal procedures. Accounts with a zero balance that remain inactive for twelve (12) consecutive months may be closed automatically.
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. If a dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. The arbitration shall be conducted in Metro Manila, Philippines, and the language of the arbitration shall be English. The decision of the arbitrator shall be final and binding on both parties.
Notwithstanding the foregoing, lintas88 may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, mis appropriation, or violation of its intellectual property rights or other proprietary rights.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and lintas88 regarding your use of the Platform and supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter hereof.
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. lintas88's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without lintas88's prior written consent. lintas88 may assign, transfer, or delegate these Terms and its rights and obligations without restriction.
